UNCITRAL Working Group meets to discuss Negotiable Multimodal Transport Documents 

Following the mandate of the UNCITRAL Commission, UNCITRAL Working Group VI held its 41st session on 28 November to 2 December at the UN Office in Vienna to continue its work towards a new international instrument on negotiable multimodal transport documents. FIATA, as a longstanding proponent of this work, was pleased to be part of the Working Group’s discussions, in the interests of facilitating legal certainty and strengthening the possibility for financing in international trade for all modes of transport, as well as to further support FIATA’s Multimodal Transport Bill of Lading.

Discussion took place on the objectives, scope and form of a new instrument, and general support was expressed for a mode-neutral approach focused on negotiability, that would co-exist with the application of other existing conventions governing the carriage of goods under a ‘dual track approach’. The Working Group examined the preliminary draft provisions, including the necessary elements of a negotiable cargo document (NCD). Consideration was given to the need to consider the interplay between the commercial use of the NCD and the legal and regulatory requirements for customs clearance and import/export formalities connected with the international carriage of goods. The Working Group will continue its discussions at the next session which will be held on 8–12 May 2023 in New York.

UNECE Trans-Caspian Corridor meeting next week!

The UNECE will be holding a Trans-Caspian corridor meeting on 16 December, 09:00-13:00 CET. Attendance will be in hybrid format (online/in-person). The aim of the meeting is to bring the private sector and governments together, for the purpose of understanding the perspectives and needs of the private sector in the Trans-Caspian Corridor project. The outcomes of the meeting will shape the future workplan of this under the auspices of the UNECE.   

The UNECE is particularly keen to hear from FIATA Association Members in the region, and FIATA therefore invites interested Association Members from the region to participate in this meeting to provide the freight forwarding perspective. This would be an excellent opportunity to provide the freight forwarding/logistics perspective and raise any concerns and needs on this important project at inter-governmental level.

OECD Global Forum on Competition and ITF Global Maritime Logistics Dialogue 

FIATA participated in the OECD Global Forum on Competition and the concurrent ITF Global Maritime Logistics Dialogue on 1-2 December in Paris. Competition and its relation to public policy objectives was a key issue discussed. EU Competition Commission Executive Vice President, Margrethe Vestager, acknowledged that competitive markets are more resilient to external shocks noting the need to democratise the marketplace. She added that competition is inherently ‘pluralistic', i.e., when markets have lower concentration, this spreads economic power more evenly. FIATA welcomes this view, which is in line with its position. Other panels considered the effectiveness of competition law, its goals, and whether authorities should consider benefits derived from subsidies in investigations of anticompetitive behaviour.  

ICS2 Release 2 – Important Advanced Cargo Information (Air Cargo) for members!

The new European Union (EU) customs Advance Cargo Information requirement, Import Control System 2.0 (ICS2 Release 2), which focuses on airfreight, is coming into force on 1 March 2023. New requirements will call for preparation from freight forwarders worldwide exporting to the EU, in addition to economic operators within the region.

To support its members on Advanced Cargo Information requirements, FIATA is currently conducting work under the AFI Taskforce on Safety and Security composed of AFI, ABSS and CAI. With the implementation date fast approaching, FIATA would like to understand how prepared the industry is for these changes.

FIATA is invited to update the European Commission DG TAXUD on the industry readiness during the Trans-European Coordination meeting for ICS2 Release 2 on Monday 12 December 2022.
